Designated Representative

Definition

An entity or individual appointed by an organization to serve as its representative in a jurisdiction where it doesn't have a physical establishment. GDPR requires non-EU organizations subject to GDPR to designate representatives in the EU (Article 27) unless exempt. Similarly, UK GDPR requires non-UK organizations to appoint UK representatives. The designated representative serves as point of contact for supervisory authorities and data subjects regarding processing activities, though the representative doesn't assume liability for the organization's actions. The representative must be established in a member state where data subjects whose data is processed are located. Designated representatives facilitate communication, help ensure compliance with local requirements, and provide local presence for accountability purposes. Organizations should appoint representatives when required, provide representatives with necessary information and authority, ensure representatives understand their role, and maintain clear communication channels.
